Colorado law (HB 1023) requires that Continuing Education verify that students receiving in-state tuition, the College Opportunity Fund, and some types of financial aid are legally present in the United States. Students verify that they are legally present by completing an affidavit.
You can verify your legal presence in one of three ways:
1. Complete an affidavit in person at Continuing Education or the University Registrar’s Office. You will need to bring an approved photo ID to complete the affidavit.
2. Complete and submit the Free Application for Federal Student Aid (FAFSA) at www.fafsa.ed.gov.
3. Download the PDF at registrar.colorado.edu/students/pdf/affadavit
_verifying_citizenship.pdf. Mail the completed and notarized form to: Continuing Education and Professional Studies, University of Colorado at Boulder, 178 UCB, Boulder, CO 80309.
If you do not verify your legal presence you will be reclassified as a nonresident of Colorado and charged the higher nonresident tuition.
You need to complete the affidavit if:
1. You have not previously completed the affidavit,
2. You have not completed the FAFSA application for financial aid,
3. You have not applied for COF (applicable to ACCESS students only), and
4. You are claiming Colorado residency for tuition classification
You also need to complete the affidavit if:
1. You have not previously completed the affidavit, FAFSA, or COF, and
2. You are applying for the Nontraditional Student Scholarship
You do NOT need to complete the affidavit if:
1. You are enrolled in a program whose tuition is not based on your status as a resident (such as Independent Learning or Personal Enrichment), and
2. You are NOT applying for the Nontraditional Student Scholarship
